An abutter to the town-owned Rotary Park in Dublin has agreed to move a car port that was discovered to be over the town line, and pay part of the cost of survey fees that discovered the issue.
Jim Beemis, of 399 Main St., met with the Select Board during its meeting Tuesday to discuss the issue.
In May, Dublin residents approved a warrant article to take on the stewardship and maintenance of Rotary Park, and also approved funds to conduct a partial survey of the property. During the survey, it was found that Beemis’ carport was built partially over the property line, and there had also been the removal of some trees on town property, and horseshoe pits installed on town property.
After discussion with Beemis Tuesday, it was agreed that the carport would have to be moved, as well as obtain a proper building permit, which was not obtained when the garage was first put up. The new proposed location of the carport is within the required setback from town property lines, and Beemis will have to apply for a variance from the Zoning Board of Adjustment before moving forward.
The board also discussed the horseshoe pits, and decided to simply allow them to become public recreation areas, unless the Conservation Commission had objections, or they became an impediment to accessing the water.
“It seems minor to me,” said Select Board Chair Chris Raymond. “If they become a problem, we’re going to remove them, simple as that.”
The board initially had issued a letter to Beemis ordering him to pay the total cost of the survey on his property, as well as to replace three survey pins missing from the property line, a total of about $2,500. During Tuesday’s meeting, Beemis came to a compromise with the board and agreed to pay $1,300 of the cost, with the remaining cost paid by the town.
