The following are proposed zoning amendments to be voted upon on May 10 at the Town House by Peterborough residents.

Amendment A would replace the requirement of obtaining a Special Exception from the Zoning Board for crossings and other uses in the Shoreland Conservation Zone with the requirement of obtaining a Conditional Use Permit from the Planning Board. The CUP would be based of the same criteria as currently exist.

This amendment would make requirements for use of the Shoreland Conservation Zone consistent with what is currently required for the Wetland Protection Overlay Zone.

Amendment B makes an accessory dwelling units, or โ€œin-law apartmentsโ€ an allowed use by right, and eliminates the requirement of obtaining a special exception.

The amendment would limit the size of the unit to 750 square feet or 30 percent of the size of the single-family dwelling, whichever is larger, and allow not up to three bedrooms.

Amendment C would allow bed and breakfasts to operate by conditional use permit in the Family District, General Residence District and Rural District.

This replaces the existing requirement of obtaining a special exception in the General Residence District. The ordinance also establishes a maximum of 12 guest bedrooms, and gives the Planning Board the authority to limit the number of bedrooms based on the surrounding neighborhood.

The Conditional Use Permit criteria would be the same as was previously established where B&Bs are currently allowed.

Amendment D clarifies that if any provision of the Zoning Ordinance is declared invalid by a court decision, the validity of the ordinance as a whole is not affected.

Amendment E adds definitions for โ€œDwelling, Two family,โ€ โ€œImpervious Surface,โ€ โ€œImpervious Cover,โ€ and โ€œSubdivision.โ€

Amendment F clarifies that condominium proposals must comply with the zoning ordinance and are subject to applicable Subdivision and Site Plan Regulations and approvals.

Amendment G clarifies that the existing minimum lot size standard of 50,000 square feet for siting a new two-family homes also applies to the conversion of an existing single-family home to a two-family home.

Amendment H adds examples to the existing definition of โ€œImpervious Surfaceโ€ to the Ground Water Protection Overlay District portion of the ordinance.

Amendment I allows restoration of a previously disturbed area in the Wetlands Protection Overlay District.

Amendment J corrects a citation error in the Wireless Communication Regulations section of the ordinance.

Amendment K would allow LEDs as a permitted type of light source for exterior lighting.

Amendment L would rezone a parcel of land on the east side of Route 202 South from General Residence District to Business/Industrial District.

This land was previously within the Business/Industrial District and was rezoned by petition to General Residence District in 2012. This amendment is by petition and supported by the Planning Board.
