The Temple ZBA stood by their decision to grant a special exception to expand Ben’s Maple Products LLC Tuesday night, after a group of town residents submitted a request for a rehearing. However, the residents have also appealed the Board’s decisions to the Superior Court.

At the end of April, the ZBA granted permission to the maple products company owned by Temple resident Ben Fisk to construct a 16,080-square-foot building at the corner of Route 101 and Webster Highway, pending certain conditions. Those included limits on tractor trailer traffic, boundaries regarding food sales and sit-down dining, and planting a tree buffer on a side of the property.

Attorney Silas Little filed Tuesday rehearing request on behalf of six or seven residents of Old Revolutionary Road, who believe they will be impacted by the expansion, he said. This is the second request for a rehearing of the application the group has filed. “Both have been rejected,” by the ZBA, he said.

The Superior Court still needs to weigh in, though. Little filed an appeal to the Superior Court after the Zoning Board determined the building expansion didn’t require a variance, he said, and he plans to update that appeal now that the ZBA has finalized the conditions of the project’s special exception. A hearing date has not been scheduled yet, Little said.
