WILTONAsphalt plant rehearing denied

The Wilton Zoning Board of Adjustment rejected for a third time a request for a rehearing on the matter of a variance for an asphalt plant on Quinn Drive.

The asphalt plant and storage silo would have been allowed in the industrial district, but both exceeded the height limit for the district, with the plant planned to be 68 feet tall, and the silo 72 feet tall. The ordinance limits structures to a maximum height of 45 feet in the industrial zone.

The board denied the variance for the height, which developers said is necessary to build the structure. The board has also denied a request for rehearing on two prior occasions, first on Dec. 10 when board member Joanna Eckstrom requested a rehearing, and again on Dec. 17, when the applicants requested one.

On March 22, the applicants, Quinn Properties, requested a rehearing for a second time. In its letter requesting a rehearing, Quinn Properties, through its attorney, Daniel Muller, Jr., contests five points of the boardโ€™s rejection of the variance.

The board was unconvinced that the application for a rehearing raised any new ground, however.

In a virtual meeting over Zoom, the Zoning Board voted unanimously to reject the application for a rehearing.

โ€œI donโ€™t see that there is anything new here,โ€ Eckstrom said.

โ€œI was not persuaded there was anything in there that was a justification for a rehearing,โ€ Chair Neil Faiman agreed.

The board, after taking a straw poll, agreed not to debate the request for a rehearing point-by-point.

โ€œIt doesnโ€™t sound like anyone has a great desire to talk about this more,โ€ Faiman said.

Eckstom moved to deny the request for a rehearing, and the board voted unanimously to do so.
