A former Jaffrey man who successfully appealed for a new trial in his sexual assault case has reached a plea deal.
Jason Wilbur, 44, was found guilty on May 12, 2011 of two counts of aggravated felonious sexual assault after a jury determined he had molested a girl between the ages of 5 and 10 between 2002 and 2007.
Wilbur had been sentenced to 10 to 20 years in state prison on Aug. 4, 2011, but he was released on a $25,000 unsecured appearance bond in December after the New Hampshire Supreme Court ruled in October that Wilbur’s attorney provided him with a constitutionally deficient defense during the trial.
Wilbur had also been found not guilty of two other charges of aggravated felonious sexual assault during the May 2011 trial.
“The cumulative impact of defense counsel’s errors is such that the defendant was prejudiced in this instance,” read the opinion issued by the court.
Wilbur is scheduled for a plea and sentencing hearing at the Cheshire Superior Court on May 29 according to court documents.
Details of the plea deal have not been filed.
